Terms & Conditions

Once you have selected a program, please review the terms and conditions as your booking is subject to the provisions listed below. Payment for a reservation for any Cusco Waliki Tours program or tour shall imply consent to all the provisions in the Booking Terms & Conditions set forth herein and is binding on all tours.

General

  • The program can vary according to the weather conditions as well as the preferences of the group.
  • Cusco Waliki Tours cannot be held accountable for any loss or damage to the personal belongings of the client or any resulting consequences due to such loss or damage.
  • We cannot assume responsibility for any illness or accident that may occur. If you become ill or an accident takes place, the responsibility and associated costs lie with the client.
  • The client is liable for the borrowed equipment, and the full cost of any damage or loss must be compensated upon return to Cusco.
  • The client declares that he or she is physically and mentally fit. Cusco Waliki Tours cannot be held responsible for any consequences if this is not the case.

Booking Procedures (Deposit)

Please contact us prior to making any payment. A 50% deposit per person for the selected program is required at the time of booking. This deposit is non-refundable in the event of cancellation by the client. By doing so, you enter into an agreement with Cusco Waliki Tours. We will then accept and confirm the booking. Please note that travel arrangements are not confirmed until stated in writing by Cusco Waliki Tours.

This Pre-payment of 50% can be made through WESTERN UNION, PAYPAL, or online payments. The transfer should be made in the name of Cusco Waliki Tours staff.

Cusco Waliki Tours will NOT cover any bank taxes and transfer costs. All transfer costs must be borne by the client.

Payment of Final Balance

  • The program price is in U.S. dollars. We require you to pay the final balance at our office at least 24 hours before your tour. Currently, we accept cash (Peruvian soles or American dollars) and Visa (with an 8% commission charge).
  • The program price per person is agreed upon at the time of the booking confirmation and will remain unchanged.

Cancellation by you

In the event of cancellation by the client, this must be communicated to Cusco Waliki Tours in writing. Please be aware that the deposit is non-refundable. Kindly provide the reason for cancellation, as your insurance policy may provide coverage.

If the cancellation notification is received more than 15 days prior to the departure date, the client will forfeit 50% of the deposit. If the cancellation occurs between 15 to 7 days before departure and the tour price has been fully paid in advance, 50% of the tour price will be refunded. However, if the cancellation is made less than 48 hours before departure or involves canceling only a part of the tour, no refund will be issued.

Cancellation/Changes by us

In situations beyond our control, such as technical issues, weather conditions, strikes, riots, or government decisions, Cusco Waliki Tours will propose alternative arrangements or comparable travel options, but refunds will not be provided. We reserve the right to modify the scheduled itinerary accordingly. While we strive to provide the originally booked program, changes may occur.

If significant changes are necessary, we will inform you, if possible, before the departure date and offer alternative arrangements of similar value. Any additional expenses incurred as a result will be the responsibility of the client. Please note that Cusco Waliki Tours will not reimburse any supplementary expenses related to tour preparations, including international tickets, visa costs, vaccinations, and others.

Cancellation caused by Cusco Waliki Tours: We will refund 100% of your payment.

Acceptance of Risk

Some of Cusco Waliki Tours itineraries are designed to expose participants to the true nature of the visited environment. Consequently, they involve inherent personal risks, which may lead to physical or emotional injury, paralysis, death, or damage to the client, their belongings, or third parties. The client acknowledges that such risks cannot be fully eliminated without compromising the essence of the activity and willingly assumes them as part of the tour. The client releases Cusco Waliki Tours from any liability regarding accidents or injuries that may occur.

Authority on Tour

The final decision on any matters that may endanger the safety and well-being of the tour group rests with the guide or representative of the company. Clients must adhere to the instructions provided by the guide throughout the tour.

Clients are required to strictly comply with Peru’s laws and drug regulations. Failure to do so, or any behavior that jeopardizes the group’s well-being, may result in the guide or company representative instructing the client to leave the tour without any refund.

Travel Documents

Clients must possess a valid passport. The original document or a copy must be carried during the tour.

Travel Insurance

We strongly recommend obtaining travel insurance that covers accidents, medical expenses, emergency repatriation, including rescue and air ambulance services. It is also advisable to ensure coverage for trip cancellations and loss of luggage.

Third-Party Services

While Cusco Waliki Tours directly operates some of the services included in the program, we also make arrangements with airlines, hotels, and other independent parties to provide the purchased travel services. We take reasonable steps to ensure that these service providers meet our quality standards. However, they are independent suppliers, and we do not have complete direct control over them.

Therefore, Cusco Waliki Tours cannot accept liability for any losses, damages, inconveniences, delays, etc., arising from their services.

Claims and Complaints

If a client has a complaint against the company, they should first inform the guide during the tour, allowing the guide to address the issue. Any subsequent complaints must be submitted in writing to the company within 7 days after the tour’s conclusion.

Claims or disputes shall be exclusively settled in Cusco, Peru. The courts of Cusco, applying Peruvian Law, shall have exclusive jurisdiction.

Damage claims against Cusco Waliki Tours shall be limited to the value of the disputed item. The company’s liability is restricted to the full price paid for the tour. In all cases, the company explicitly disclaims liability for indirect, incidental, or consequential losses or expenses, including loss of profits.
